Acceptance of Terms
By accessing and using MSP Dark Intel’s services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.
These terms apply to all users, including MSPs, their clients, and any authorized personnel accessing our platform.
Service Description
Dark Web Monitoring
Continuous monitoring of dark web sources for compromised credentials and data breaches affecting your organization or clients.
Threat Intelligence API
Programmatic access to our threat intelligence database through RESTful APIs with comprehensive search and filtering capabilities.
White-Label Solutions
Customizable platform integration allowing MSPs to brand and integrate our services into their existing offerings.
Reporting and Analytics
Comprehensive reporting tools and analytics dashboards for tracking security incidents and client communications.
User Accounts and Registration
Account Creation
You must provide accurate, current, and complete information during registration and maintain the accuracy of your account information.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Authorized Users
You may authorize team members to access your account. You remain responsible for all activities by authorized users.
Account Suspension
We reserve the right to suspend or terminate accounts that violate these terms or engage in suspicious activity.
Acceptable Use Policy
Illegal Activities
- Using our services for any illegal purpose or in violation of applicable laws
- Attempting to access unauthorized systems or networks
- Distributing malware, viruses, or other harmful code
Platform Abuse
- Reverse engineering or attempting to extract our source code
- Excessive API usage that impacts service performance
- Creating multiple accounts to circumvent usage limits
Data Misuse
- Sharing account credentials with unauthorized parties
- Using data for purposes outside of legitimate security operations
- Attempting to re-identify anonymized information
Payment Terms and Billing
Subscription Fees
Subscription fees are billed monthly in advance and are non-refundable except as required by law or as specifically stated in these terms.
Payment Methods
We accept major credit cards and bank transfers. Payment information must be current and accurate.
Late Payments
Services may be suspended for accounts with overdue payments. A grace period of 7 days is provided before suspension.
Price Changes
We reserve the right to modify pricing with 30 days advance notice. Changes will not affect your current billing cycle.
Cancellation
You may cancel your subscription at any time. Service will continue until the end of your current billing period.
Data and Privacy
Data Ownership
You retain ownership of any data you provide to our platform. We do not claim ownership of your customer data or monitoring configurations.
Data Processing
We process data in accordance with our Privacy Policy and applicable data protection laws, including GDPR and CCPA.
Data Security
We implement industry-standard security measures to protect your data, but cannot guarantee absolute security.
Data Retention
Data is retained according to our Privacy Policy and may be retained for legal compliance even after account termination.

Service Availability and Support
Uptime Commitment
We strive to maintain 99.9% uptime but do not guarantee uninterrupted service availability.
Maintenance
Scheduled maintenance will be communicated in advance. Emergency maintenance may be performed without notice.
Support
Technical support is provided during business hours via email and support portal. Response times vary by subscription level.
Service Modifications
We may modify, suspend, or discontinue services with reasonable notice to users.
Limitation of Liability

Our services are provided “as is” without warranties of any kind. We do not guarantee detection of all threats or data breaches.
Damages Limitation
Our total liability shall not exceed the amount paid by you in the 12 months preceding the incident giving rise to liability.
Excluded Damages
We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data.
Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control.
Termination
Termination by You
You may terminate your account at any time by contacting our support team or through your account settings.
Termination by Us
We may terminate accounts for violations of these terms, non-payment, or other legitimate business reasons.
Effect of Termination
Upon termination, your access to services will cease and your data may be deleted according to our retention policies.
Survival
Sections relating to payment obligations, intellectual property, and limitation of liability survive termination.
Governing Law and Disputes
Governing Law
These terms are governed by the laws of the jurisdiction where MSP Dark Intel is incorporated, without regard to conflict of law principles.
Dispute Resolution
Disputes will be resolved through binding arbitration in accordance with commercial arbitration rules.
Class Action Waiver
